1. Acceptance of Terms

By accessing or using the website, software applications, developer tools, or engineering services provided by Arkaic Technologies Inc. ("Arkaic," "we," "us," or "our"), you agree to be legally bound by these Terms of Use. If you do not agree with any part of these terms, you must discontinue use of our platforms immediately.

2. Intellectual Property Rights

All content, source code, visual designs, 3D WebGL components, trademarks, brand assets, and proprietary security architecture (including MetriGraph CSPM) are the exclusive intellectual property of Arkaic Technologies Inc.

Client Deliverables: Custom software, applications, and cloud architecture developed specifically for enterprise clients under executed Master Services Agreements (MSAs) are assigned to the client upon full payment.
Proprietary Core Systems: Pre-existing software frameworks, developer utilities, security audit engines, and zero-trust algorithms remain the sole property of Arkaic Technologies Inc.

3. Acceptable Use & Security Perimeter

You agree to access our platforms solely for lawful purposes and in accordance with these Terms. You explicitly agree not to:

Attempt unauthorized access, penetration testing, or vulnerability scanning against Arkaic infrastructure without prior written authorization signed by an executive officer.
Execute Distributed Denial of Service (DDoS) attacks, automated web scraping, or malicious packet injection against our servers.
Reverse-engineer, decompile, or extract source code from proprietary binary assets or compiled web engines.

4. Service Availability & Warranties

While we strive for 99.99% operational uptime across our developer platforms and cloud tools, website access is provided on an "as is" and "as available" basis. Arkaic disclaims all warranties, express or implied, regarding uninterrupted availability, fitness for a specific purpose, or error-free operation.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Arkaic Technologies Inc. and its founders, officers, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, goodwill, or operational disruption—arising out of your access to or inability to access our platforms.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in India, serving enterprise clients globally.
